1-Hour Standard Photo Session Agreement
60-Min Standard Photo Session Agreement
SESSION DURATION: 60 minutes.
SESSION PRICE: $600 + Sales Tax (4%)
DELIVERY: 60+ Digtal Photographs.
DELIVERY FORMAT: 45MP JPG files.
This agreement is made between the Client, whose name and contact information are listed above, and Blue Horizon Photography by Paul Palop. All photographs will be shot in digital camera RAW format. Digital photos will be made available on a private online gallery ready for download, ready for social media sharing and the option to order physical prints online. Printing rights will be fully granted. Photos will be delivered as high-resolution JPEG files within 7-14 days of the session.
1. Payments. Client agrees to submit full payment at least two (2) days prior to the scheduled session date. Photographer reserves the right to cancel the session if payment is not received within this timeframe.
2. Artistic Rights. Blue Horizon Photography retains the right of discretion in selecting, every and ALL the photographs released to the client.
3. Editing and Retouching. The Photographer’s editing style is consistent with the professional standards and aesthetic represented in the Photographer’s portfolio. By entering into this Agreement, the Client acknowledges and accepts the Photographer’s artistic judgment and editing approach.
All delivered images will include professional color correction and standard post-processing, including exposure adjustment, cropping, and overall tonal balancing. Such editing does not include extensive cosmetic or structural alterations unless expressly agreed to in writing prior to the session.
The Photographer may, at their discretion, apply limited retouching to select images where deemed appropriate. This may include minor cleanup of temporary blemishes or small, non-distracting elements. Any such adjustments are subtle in nature and are not intended to alter the overall appearance of subjects or the environment.
Requests for additional retouching—including, but not limited to, hair flyaway reduction, skin smoothing, tan line or sunburn reduction, body modification, clothing adjustments, background cleanup, object removal, or head replacements—are subject to the Photographer’s sole discretion and evaluation of feasibility.
The Client acknowledges that certain conditions, including but not limited to strong tan lines, sunburn, harsh lighting, complex backgrounds, or significant physical alterations, may not be fully correctable or may require substantial post-production time.
The Photographer reserves the right to decline any retouching request that exceeds reasonable editing scope or is inconsistent with their artistic standards. Approved retouching requests may be subject to additional fees at the Photographer’s current post-production rate.
4. Copyright and Reproductions. Blue Horizon Photography owns the copyright of all images created during the session and shall have the right to display them on the photographer’s website, social media and/or studio, while keeping Client's personal information private and non-disclosed.
5. Raw Files, Editing Files and Copyright. The Photographer retains full copyright and ownership of all images captured during the session, including but not limited to all original, unprocessed image files (“RAW files”) and any associated editing data files (e.g., .XMP sidecar files).
RAW files are not included in the client’s package and will not be released unless purchased separately. Should the Client choose to purchase the RAW files, they may do so at a flat fee of $3,000, regardless of the number of files provided. Purchase of RAW files grants the Client personal use rights only and does not transfer copyright, licensing rights, or ownership of the images.
6. Client Health, Mobility, and Location Accessibility. Some photo session locations may require walking, short hikes, or navigating uneven terrain. The Client is responsible for informing the Photographer before the session is booked of any medical conditions, physical limitations, disabilities, or other factors that could affect any member of the party’s ability to safely access and return from the chosen location.
7. Client Provided Shot-Lists. While the Photographer will make every reasonable effort to capture the images requested by the Client, including any shot lists provided, the Client understands and agrees that no specific image is guaranteed. Factors such as timing, weather, lighting conditions, location restrictions, distractions, and other unforeseen circumstances may affect the Photographer’s ability to capture every requested shot. The Client acknowledges that the Photographer retains full discretion regarding creative decisions, including composition, posing, and prioritization of shots, to ensure the best possible results. The Photographer will not be held responsible or liable for any photographs that were not captured from the Client’s provided list.
8. Print Release. The purchase of your photography session grants you permission to make an unlimited number of copies and/or prints of any of the images on the gallery for the Client's personal use.
9. Cancellation Policy. Client may cancel the scheduled photography session at any time prior to the session start time without incurring any cancellation fees or penalties and shall be fully refunded. No advance notice is required. Photographer shall not hold Client liable for any fees, charges, or damages due to cancellation for any reason, including last-minute cancellations. Client is encouraged to notify Photographer as soon as reasonably possible if cancellation becomes necessary.
10. Refund Policy. In the event of a cancellation, Client shall receive a full refund of any amount previously paid to Photographer, regardless of the timing or reason for cancellation. All payments are non-refundable once the photography session has commenced, unless safety conditions during the session change (weather changes, for example). No refunds shall be issued after the scheduled session has taken place, regardless of the Client's satisfaction with the final product or services rendered.
11. Weather Policy. In the event of inclement weather (including rain, unsafe conditions, or conditions that materially impact the quality or safety of the session), the Client may request to reschedule or cancel the session (see Cancellation and Refund Policies). Any decision to proceed, reschedule, or cancel due to weather, shall prioritize safety and the Photographer’s professional judgment regarding shoot quality and safety.
12. Social Media. Client is free to share any photographs taken during the session anyway they see fit on social media. Client also agrees to credit Paul Palop when posting images on social media, whenever possible. Credit should be included in the caption or photo tag (e.g., “@paulpalop” or “Photo by @paulpalop” or "Photo by Paul Palop").
While not legally required, this credit helps ensure proper recognition and supports the continued creative work of the photographer.
13. Failure to Perform. If the Photographer is unable to fulfill this agreement due to illness, emergency, fire, casualty, strike, unsafe environment, threat, act of God, or any other cause beyond the Photographer’s control, the Photographer shall not be held liable for missing the scheduled session. In such an event, the Client shall be fully refunded. The Client also has the option to reschedule the session at a mutually agreed-upon time.
14. Indemnification. Photographer shall not be held liable for any accidental injury to the Client during the course of the photography session.
15. Miscellany. This agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties.
